Summary

• You can use much of the content for free. Premium costs €4.95 per month (VAT included), with no minimum term. Adults (18+) only.
• Cancel whenever you like from your profile or at Cancel contract; Premium stays active until the end of the month you have paid for.
• If you buy Premium as a consumer, you have 14 days to withdraw and we refund everything you paid.
• Your progress is yours: you can delete your account and data at any time.

1. Who we are and scope

The full name and address of the provider are in the Impressum. These terms apply to all use of the website and the app. Licences for schools and educational institutions are additionally governed by their own contract and data processing agreement (more in the guide for schools).

2. The service

We offer activities, lessons, exercises, readings and vocabulary for learning Spanish from level A1 to C2, with progress tracking (XP, streaks, medals), social features and classes for teachers.

• Free: part of the content, with ads if you accept them in the cookie notice.
• Premium: all content, no ads and extra features (section 6).

We keep extending and improving the content. We may change or remove individual activities for a valid reason (for example, educational or technical corrections), provided Premium keeps its essential features and at no extra cost to you. We aim to keep the service available at all times, but there may be short interruptions for maintenance or technical reasons.

3. Your account

• You must be at least 13 years old to create your own account. Children under 13 may only use the platform with a school account created from a teacher’s class.
• Premium can only be bought by people who are at least 18 years old. Minors can keep using the free content and school accounts.
• Your registration details must be true. Each person uses their own account and does not share it.
• Keep your password secret and tell us if you think someone has accessed your account.
• You can delete your account at any time from your profile (“Delete my account”). If you have Premium, the subscription is cancelled at the same time.

4. Acceptable use

You may use the platform to learn or teach Spanish. You may not:

• copy, bulk-download, resell or publish the content outside the platform;
• share your Premium access with other people;
• use bots, scrapers or other automated means, or try to bypass security measures;
• post illegal, offensive or discriminatory content, harassment, spam or other people’s personal data in forums, profiles or messages.

If someone breaks these rules we may delete the content concerned and, after a warning, suspend or close the account. In serious cases (for example, illegal content or harassment) we may do so without prior warning.

Content notices and moderation: anyone can tell us about illegal content or content that breaks these rules using the form to report content. We review every notice manually, diligently and objectively, without automated moderation tools. If we remove or block content or restrict an account, we tell the person concerned why (Articles 16 and 17 of the Digital Services Act). You can contest the decision by replying to that email; you may also go to court. Single point of contact for users and authorities: info@hspanishacademy.com (Spanish, English or German).

5. Content and rights

The texts, exercises, audio, images, designs and software of H Spanish Academy are protected by copyright. We grant you a personal, non-exclusive, non-transferable right to use them within the platform for learning. Teachers may also use them with their own students in class, but may not publish or distribute them outside it.

What you post (for example, class forum messages or your avatar) remains yours. You allow us to show it within the platform, only to the people it is meant for, until you delete it.

If you believe any content infringes your rights, let us know via our copyright agent or the contact form.

6. Premium: price and payment

• Student plan: €4.95 per month (VAT included). The price you see before paying is the final price.
• Payment is made in advance with Stripe (card and the other methods shown at checkout) or with PayPal. The contract is concluded when you click “Subscribe and pay” and the payment is completed; Premium access is activated at that moment. We then send you a contract confirmation with these terms by email.
• The subscription renews automatically every month and is charged at the start of each new month until you cancel it. There is no minimum term.
• With Premium you can be signed in on up to 3 devices at the same time (computer, phone, tablet or the app). If you sign in on another one, the oldest session is signed out automatically and we let you know. You can view and sign out your sessions in your profile (“Active sessions”).
• The Teacher Premium plan and school licences are offered individually on request.

7. How to cancel Premium

You can cancel at any time, free of charge:

• from your profile, with the “Cancel subscription” button;
• on the Cancel contract page (linked in the footer of every page, also without logging in); or
• by writing to info@hspanishacademy.com.

We confirm your cancellation by email straight away, with the date and time we received it. Cancellation takes effect at the end of the month already paid: until then you keep Premium, and afterwards you are not charged again. Your progress, statistics and word bank are kept. This does not affect your right of withdrawal (section 8).

8. Right of withdrawal

If you are a consumer, you have the right to withdraw from the Premium contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded.

To exercise it, you must inform us of your decision by an unequivocal statement (for example, a letter sent by post or an email) to: Javier Hoballah Lorenzo, H Spanish Academy, Kolonnenstraße 8, 10827 Berlin, Deutschland, info@hspanishacademy.com. You can also use the website’s withdrawal function (“Withdraw from contract”, in the footer of every page): we will immediately send you an acknowledgement of receipt by email. You may use the model form below, but it is not obligatory. It is enough to send your communication before the withdrawal period expires.

Effects: we will refund all payments received from you without undue delay and no later than 14 days from the day we receive your communication, using the same means of payment you used (unless we agree otherwise). You will not be charged any fees for the refund.

9. Changes to prices and to these terms

If we want to change the Premium price, we will tell you by email at least 30 days in advance. The new price only applies if you accept it; if you don’t, we may end the subscription at the end of the current month and you won’t be charged again.

We may update these terms because of legal or service changes. We will tell you in advance about changes that affect you. Essential changes to an ongoing contract only apply if you accept them; otherwise you can cancel Premium or delete your account free of charge.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slight negligence we are only liable if we breach an essential contractual obligation (one whose fulfilment makes the contract possible and on which you may rely), and only up to the typical, foreseeable damage.

Your statutory warranty rights for digital products are not affected. We do our best to make the content correct, but we cannot guarantee a specific learning result, such as passing an exam.

11. Termination by us

We may end a free account with 30 days’ notice. For good cause (for example, a serious breach of section 4 after a warning, or payment fraud) we may close any account without notice. If we close a Premium account through no fault of yours, we refund the pro-rata part of the month already paid.

12. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another EU country, you also keep the protection of the mandatory rules of your country of residence.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (see Impressum).
